These Terms of Service ("Terms") govern your use of the CalScanner mobile application ("App", "Service"). By downloading, installing, or using CalScanner, you agree to be bound by these Terms. If you do not agree, please do not use the App.
CalScanner is a nutrition estimation tool that uses artificial intelligence to analyze food photographs and provide approximate calorie and macronutrient breakdowns. The App also provides tools for logging meals and tracking daily nutritional intake. CalScanner is intended as a general wellness tool and is not a medical device or diagnostic instrument.
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use CalScanner. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.
CalScanner uses Sign in with Apple as the sole method of authentication. You are responsible for maintaining the security of your Apple ID and any activity that occurs through your authenticated session. We do not create separate account credentials. If you believe your session has been compromised, you should sign out from the App and revoke access through your Apple ID settings.
CalScanner does not provide medical advice, dietary prescriptions, clinical nutrition counseling, or health diagnoses. All nutritional information displayed in the App consists of AI-generated estimates that may be inaccurate, incomplete, or unsuitable for your specific health needs.

Nutrition estimates are generated by AI based on visual analysis of food photographs. Results can vary based on image quality, lighting, food presentation, hidden ingredients, and portion perception. The same food may produce different estimates across scans. CalScanner makes no warranty regarding the accuracy, completeness, or reliability of any nutritional estimate provided.
Certain features of CalScanner require an active subscription, which is billed through Apple In-App Purchases. By subscribing:

All content, design, graphics, interfaces, and code within CalScanner are owned by us or our licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
CalScanner relies on third-party services to operate, including Cloudflare for request processing and OpenAI for AI-powered food analysis. These providers operate under their own terms of service and privacy policies. We are not responsible for the actions, availability, or policies of third-party providers. Service interruptions from third-party providers may affect app functionality.
Food photographs you submit through the scanner are processed transiently to provide nutritional analysis. By using the scanner, you represent that you have the right to capture and submit the photographs you provide. You retain ownership of your photographs; however, you grant us a limited license to process them solely for the purpose of providing the scanning service.
To the maximum extent permitted by applicable law, CalScanner and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. This includes but is not limited to damages resulting from reliance on nutrition estimates, health decisions made based on app data, or service interruptions.
Our total liability for any claim related to the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim, or $50 USD, whichever is greater.
CalScanner is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that nutritional estimates will be accurate.
You agree to indemnify, defend, and hold harmless CalScanner and its developers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We reserve the right to suspend or terminate your access to CalScanner at any time, with or without cause, and with or without notice. You may stop using the App at any time by deleting it from your device. Sections regarding limitation of liability, disclaimers, and indemnification survive termination.
We may modify these Terms at any time. Updated Terms will be posted within the App with a revised "Last updated" date. Your continued use of CalScanner after the posting of changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
